Between Frederick Oetzmann & Sons
Plaintiffs
and
James M. Whistler
Defendant

I Charles Isaac Hayton[5] of 38 Conduit Street, Bond Street, in the County of Middlesex Clerk to the above named Plaintiffs - make oath and say as follows: -

1.  This Action is brought upon a Writ specially endorsed to recover the sum of £23. 13. 3 for the hire of Pianos let on hire by the Plaintiffs to the Defendant and the tuning thereof and carriage paid by the Plaintiffs for the Defendant at his request between the 28th June 1875 and 3rd May 1877 in which said sum the Defendant was at the commencement of this Action and still is justly and truly indebted to the Plaintiffs

2.   In my Judgment and belief the Defendant has no defence to the Action on the merits.

3.   I have made many applications to the Defendant for payment of the Plaintiffs said demand and the Defendant has repeatedly promised to pay the same and has never at any time disputed the correctness of the Plaintiffs account. -

4.   I am a person in the employ of the Plaintiffs and am duly authorized by them to make this Affidavit and the above [p. 3] facts are all within my own knowledge true. -
